This Intellectual Property (IP) Policy outlines how copyright and usage rights work for all photography and videography services we offer.

It applies to our Clients; Employees of our clients; Travel agents; Tourism bodies; Media publications; Contractors; and Any third party who accesses, downloads, shares, reposts, republishes or interacts with our work in any format.

In accordance with South African copyright law (Copyright Act No. 98 of 1978), we retain full ownership of all intellectual property and copyright of the work we create unless a written agreement states otherwise. By engaging our services or interacting with our content, you agree to this policy.

1. Copyright Ownership

All creative works produced by Gianni Creative Studio, including but not limited to:

  • Photographs

  • Video footage

  • Edited films

  • Audio recordings

  • Visual concepts

  • Storyboards

  • Creative direction

  • Colour grades

  • Written scripts

are the sole intellectual property of Gianni Creative Studio under South African copyright law.

Copyright remains exclusively with Gianni Creative Studio at all times.

Payment for services does not transfer copyright ownership.

2. License Granted to Clients

Upon full payment, the contracted Client receives a non-exclusive, non-transferable, non-sublicensable commercial marketing license.

This license permits the Client to use the final delivered content for:

  • Their own lodge or brand website

  • Their own social media accounts

  • Paid digital advertising

  • Print marketing materials

  • OTA listings

  • Sales presentations

  • Email marketing

 

The license applies only to the legal entity that contracted Gianni Creative Studio.

3. What Clients Are Not Permitted To Do

The Client may not:

  • Sell the content

  • License the content to third parties

  • Transfer usage rights to a new owner without written consent

  • Provide content to other lodges within a group without approval

  • Provide footage to external production companies for re-editing

  • Submit content to stock libraries

  • Claim authorship of the work

  • Alter the work in a way that damages its integrity

  • Remove embedded metadata where present

 

If ownership of the lodge changes, usage rights do not automatically transfer (a new license agreement may be required).

4. Raw Materials & Internal Assets

The following are never released, sold or licensed:

  • RAW image files

  • Unedited video footage

  • Editing timelines

  • Colour grading files

  • Project files

  • Internal production assets

 

These remain permanently and exclusively the property of Gianni Creative Studio.

5. Third-Party & Public Use Restrictions

Any individual, company or organisation that encounters our work, including through:

  • Social media

  • Websites

  • Tourism platforms

  • Press features

  • Marketing collateral

may not:

  • Download and reuse images or video

  • Repost without consent and credit

  • Crop out branding or watermarks

  • Use content for commercial gain

  • Use content for editorial publication without permission

  • Submit content to competitions

  • Use content in AI training systems

  • Manipulate, alter or repurpose the work

 

All third-party usage requires prior written permission from Gianni Creative Studio.

6. Travel Agents & Tourism Bodies

Travel agents, DMCs, tourism boards and external marketing bodies may not use our content independently for their own brand marketing without written licensing approval.

If a lodge wishes to extend usage rights to a third party, a separate licensing agreement must be arranged.

7. Online & Digital Protections

Gianni Creative Studio retains full rights to:

  • Embedded metadata

  • Digital authorship markers

  • Watermarks where applied

 

Removal of identifying data or deliberate concealment of authorship constitutes copyright infringement.

8. Music & Licensed Assets

Where films include licensed music:

  • The license applies only to the final delivered film.

  • Music may not be extracted, repurposed or reused.

  • Uploading to additional platforms beyond agreed scope may require extended licensing.

 

The Client is responsible for consulting Gianni Creative Studio before repurposing films in new contexts.

9. Portfolio & Promotional Rights

Gianni Creative Studio retains the unrestricted right to use produced content for:

  • Portfolio

  • Website

  • Social media

  • Awards submissions

  • Educational presentations

  • Marketing of our services

 

Unless restricted by a separately signed NDA.

10. Moral Rights

Gianni Creative Studio retains moral rights in all works created, including:

  • The right to be identified as creator

  • The right to object to derogatory treatment of the work

11. Infringement & Enforcement

Unauthorised use of any content may result in:

  • Immediate termination of licensing rights

  • Formal takedown notices

  • Commercial licensing invoices issued retroactively

  • Legal action where necessary

 

We actively monitor usage of our intellectual property.

Agreement to Policies

By booking or working with Gianni Creative Studio, you agree to our Terms & Conditions, Privacy Policy, Refund Policy and Intellectual Property Policy. If you have any questions or concerns, please reach out before confirming your production project.
